But it\u2019s still\nrestricted in many Asian countries. To understand why hemp has been banned\nthroughout Asia, we need to understand how these countries view the plant. <\/p>\n\n\n\n<p>For\nmany years \u2014 and even still today \u2014 some Asian countries don\u2019t differentiate\nbetween hemp and marijuana. This is problematic for those looking to use hemp\nfor its health benefits, rather than for the psychoactive effects of marijuana.\n<\/p>\n\n\n\n<h3>What\u2019s The Difference Between\nHemp &amp; Marijuana?<\/h3>\n\n\n\n<p>Both <a href=\"http:\/\/dailycbd.com\/en\/hemp-vs-marijuana\/\">hemp and marijuana<\/a> belong to the <em>Cannabis sativa <\/em>species, but they differ in\nappearance, composition, and use.<\/p>\n\n\n\n<h4>1. Although\nthe plant is technically capable of manufacturing THC, it\u2019s genes dramatically\nlimit how much is produced \u2014 focusing the effort on other cannabinoids instead\nlike CBD. <\/p>\n\n\n\n<p>Unlike\nmarijuana, hemp doesn\u2019t produce psychoactive effects and can\u2019t be used to get\nthe user high. <\/p>\n\n\n\n<p>Hemp\nplants also have very high fiber content in the stalks of the plant, making\nthem an excellent choice for cordage and fabrics.<\/p>\n\n\n\n<p>Hemp\nis the main source for CBD products due to the distinction many regulators make\nbetween this plant and marijuana.<\/p>\n\n\n\n<p>However, most Asian countries don\u2019t make a distinction\nbetween the two plants (yet), and treat hemp and its derivatives as a drug the\nsame way as marijuana. <\/p>\n\n\n\n<h2>Hemp Laws &amp; Regulations By Country<\/h2>\n\n\n\n<h3>1. Afghanistan <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Cannabis was freely grown in Afghanistan until\n1973 when King Zahir Shah made the plant illegal and introduced severe\npunishment \u2014 including lengthy jail time and capital punishment.<\/p>\n\n\n\n<p>Cannabis in Afghanistan has an important\ncultural role, and locals use it even today, especially in the form of hashish.\nHowever, its use and cultivation are outlawed. <\/p>\n\n\n\n<p>CBD is not legal in Afghanistan, and any\naction related to it could lead to a severe penalty. <\/p>\n\n\n\n<h3>2.\nBangladesh <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Cannabis in Bangladesh is entirely outlawed, and so are its derivatives. Penalties on cannabis possession and use are severe and include <a href=\"https:\/\/www.reuters.com\/article\/us-bangladesh-drugs\/bangladesh-sets-death-penalty-for-drug-offences-in-draft-law-idUSKCN1MI1DT\" target=\"_blank\" rel=\"noreferrer noopener\">punishment with death<\/a>. <\/p>\n\n\n\n<h3>3.\nBhutan <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>CBD is not differentiated from cannabis in\nBangladesh, and is illegal for possession, sale, and use. <\/p>\n\n\n\n<h3>4.\nCambodia<\/h3>\n\n\n\n<p><strong>Verdict:&nbsp; Banned<\/strong><\/p>\n\n\n\n<p>Cannabis is widely available in Cambodia, but\nit\u2019s prohibited by law. Refrain from buying any illegal cannabis product \u2014 it is\nsaid that cannabis use is often tolerated in Cambodia, but the punishments for\npossession and use are severe, and you could end up in prison. <\/p>\n\n\n\n<h3>5. China<\/h3>\n\n\n\n<p><strong>Verdict:\nRestricted<\/strong><\/p>\n\n\n\n<p>After being banned for 25 years, in 2010, the Chinese authorities allowed hemp cultivation in two Chinese provinces \u2014 Yunnan and Heilongjiang. According to <a href=\"https:\/\/medibulletin.com\/at-ayush-meet-experts-bat-for-medical-marijuana-legalisation\/\">officials<\/a> from AYUSH,<strong> cannabis is one of the five crucial\nmedicinal plants<\/strong> in the Vedas (religious texts). <\/p>\n\n\n\n<p>In 2017, the government licensed the Council of\nScientific and Industrial Research (CSIR) to grow cannabis for medical and scientific research. The\nCSIR is cooperating with Bombay Hemp Company (<a href=\"https:\/\/boheco.org\">BOHECO<\/a>). The Council is working on developing three cannabis-based\nmedicines that will treat cancer, epilepsy, and sickle-cell anemia.<\/p>\n\n\n\n<p>There is no formal ban or permit for CBD use in India\n\u2014 meaning it lives in a legal grey area. CBD\nis not differentiated from cannabis and is illegal for sale and use. <\/p>\n\n\n\n<p>Although you\u2019ll hear many stories about\ncannabis consumption, it\u2019s best to refrain from buying any illegal hemp or\nmarijuana products, else you could end up paying a hefty fine or even visiting\none of Iran\u2019s prisons. <\/p>\n\n\n\n<h3>9. Iraq <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Cannabis in Iraq is entirely outlawed, and the\nban includes its derivatives. <\/p>\n\n\n\n<h3>10. Israel&nbsp; <\/h3>\n\n\n\n<p><strong>Verdict: Legal for Medical Use<\/strong><\/p>\n\n\n\n<p>Israel is the world leader in CBD research and\ndevelopment but regulates the cannabinoid strictly. Penalties on any illegal\npossession of cannabis can lead to severe penalties, so it\u2019s best to refrain\nfrom purchasing CBD in Kyrgyzstan. <\/p>\n\n\n\n<h3>15. Myanmar <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Myanmar\u2019s law doesn\u2019t differentiate hemp from\nmarijuana and prohibits its use and cultivation. <\/p>\n\n\n\n<p>The country has some of the harshest penalties\nwhen it comes to cannabis possession, and getting caught with a small amount could\nland you in jail for five years. <\/p>\n\n\n\n<p>Myanmar has capital punishment for possession\nand trafficking of more massive amounts of cannabis. <strong><\/strong><\/p>\n\n\n\n<h3>20. Nepal <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Nepal\nhasn\u2019t defined its hemp laws \u2014 technically, it\u2019s illegal under the law, but\nsome territories allow cultivation under a government-issued license. <\/p>\n\n\n\n<p>While\nhemp lives somewhere in the legal grey area, CBD is not differentiated from\ncannabis and is not allowed for use. <\/p>\n\n\n\n<h3>21. North Korea <\/h3>\n\n\n\n<p><strong>Verdict: Banned [presumably]<\/strong><\/p>\n\n\n\n<p>North Korea has a well-developed hemp\nindustry, but it is supposed that CBD is not allowed. <\/p>\n\n\n\n<p>The unclear status of cannabis and CBD is due\nto North Korea\u2019s lack of transparency towards the outer world.<strong><\/strong><\/p>\n\n\n\n<h3>22. Pakistan <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Pakistan is known for its vast fields of\ncannabis \u2014 the plant grows wildly. Although prohibited by law, many locals\nconsume marijuana and hashish publicly. However, CBD is considered an illegal\nsubstance and is prohibited for sale and use.<\/p>\n\n\n\n<h3>23. Philippines <\/h3>\n\n\n\n<p><strong>Verdict: Legal for Medical\nUse<\/strong><\/p>\n\n\n\n<p>Cannabis and its derivatives are strictly\nprohibited in the Philippines. <\/p>\n\n\n\n<p>There\u2019s one exclusion \u2014 individuals suffering\nfrom a terminal illness can apply to the <a href=\"https:\/\/www.fda.gov.ph\/\">Foods\nand Drugs Authority<\/a>\nfor a special permit to use cannabis-based drugs (including CBD oil). Although\nthis rule was introduced in 1992, the stigma around cannabis still exists, and\nonly one application has been sent as of December 2018.&nbsp; <strong><\/strong><\/p>\n\n\n\n<h3>24. Qatar <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Qatar stands among the countries with the\nharshest cannabis laws. Any action related to cannabis \u2014 including hemp \u2014 is strictly\nprohibited. <\/p>\n\n\n\n<h3>25. Russia <\/h3>\n\n\n\n<p><strong>Verdict: Grey-Area (Restricted Lean)<\/strong><\/p>\n\n\n\n<p>The\nRussian <a href=\"http:\/\/government.ru\">government<\/a> allows hemp cultivation, but\nhemp can\u2019t be grown for the production and manufacture of narcotic drugs and\npsychotropic substances.<\/p>\n\n\n\n<p>CBD\nis <strong>not explicitly included<\/strong> on the <a href=\"http:\/\/www.consultant.ru\/document\/cons_doc_LAW_136206\/ce99160bb6d3dd9183f48dce1703bf45dfa78f28\/\">list<\/a> of narcotic drugs and psychotropic\nsubstances&nbsp; \u2014 however, THC is strictly\nforbidden. The prohibition falls on its isomers too, and CBD is considered a\nTHC <a href=\"https:\/\/www.acsh.org\/news\/2019\/04\/08\/cbd-and-thc-only-difference-one-chemical-bond-13937\">isomer<\/a>. <\/p>\n\n\n\n<p>Additionally,\nthe Technical Regulation on Food Safety No. 21 (<a href=\"http:\/\/www.tsouz.ru\/db\/techreglam\/Documents\/TR%20TS%20PishevayaProd.pdf\">appendix 7<\/a>) prohibits the use of all\nkinds of hemp and its parts (including derivatives) as dietary supplements. <\/p>\n\n\n\n<p>While\nthe Russian law doesn\u2019t specifically classify CBD as a controlled substance,\nthe cannabinoid falls in the <strong>restricted\ngrey area<\/strong> (it is a hemp derivative and a THC isomer).<\/p>\n\n\n\n<p>As\nof October 1019, there is one company \u2014 Kannaway \u2014 that is <a href=\"https:\/\/www.linkedin.com\/posts\/stephaniebudin_kannaway-russia-cbd-activity-6587727384751988737-0LE8\/\">permitted<\/a> to sell CBD products in\nRussia. Syria <\/h3>\n\n\n\n<p><strong>Verdict: Banned<\/strong><\/p>\n\n\n\n<p>Cannabis in Syria is illegal, as well as CBD \u2014\nregardless of the THC amount, you\u2019re not allowed to purchase CBD products.<\/p>\n\n\n\n<h3>31. Taiwan <\/h3>\n\n\n\n<p><strong>Verdict: Legal for Medical\nUse<\/strong><\/p>\n\n\n\n<p>In 2017, the government of Taiwan decided to\nlegalize CBD for medical purposes. The CBD product mustn\u2019t contain more than\n0.0001% THC and is available only for patients who have Parkinson\u2019s disease and\nepilepsy.<\/p>\n\n\n\n<p>The application process is complicated and\nacquires many documents and information that sometimes is difficult to obtain.<\/p>\n\n\n\n<p>If you have one of the two eligible medical\nconditions, you can apply for a permit to import CBD to the<a href=\"https:\/\/www.mohw.gov.tw\/mp-2.html\"> Ministry of Health and Welfare<\/a> after you obtain the following documents and\ninformation:<\/p>\n\n\n\n<ol><li>Your ID card (photocopy of the front and backside)<\/li><li>Certificate of diagnosis issued by the medical institution\/your doctor<\/li><li>A test result of the CBD product (the THC content should be less than 10 ppm)<\/li><li>Temporary manufacturing license for adult-use cannabis products<\/li><\/ol>\n\n\n\n<p>Many patients have said that they don\u2019t know\nhow to import CBD due to customs \u2014 they often <a href=\"http:\/\/taiwanenglishnews.com\/taiwans-reefer-madness-extends-to-hemp-seed-oil-public-cautioned\/\">seize imported products<\/a> and are not synchronized with the health\nauthority.
